Welcome to Transit Gigs! These Terms and Conditions (“Terms”) govern your use of the Transit Gigs platform (“Platform”), a marketplace connecting transportation professionals with work opportunities. By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
Acceptance of Terms By accessing, using, or creating an account on Transit Gigs, you agree to comply with and be bound by these Terms. We may update these Terms at any time, and any changes will be effective upon posting. You are encouraged to review these Terms periodically to stay informed about any updates.
Platform Services Transit Gigs is a digital marketplace that connects transportation professionals (“Service Providers”) with work opportunities provided by Transit Gigs. We do not directly employ Service Providers but provide the Platform to facilitate assignments and transactions between Service Providers and Transit Gigs.
User Accounts To access certain features of the Platform, you may need to create a user account. You agree to provide accurate and complete information when creating your account and to keep your information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
Communication By providing your contact information to Transit Gigs, you consent to receiving communications from us via text message, email, or phone, including marketing and transactional messages. You may opt out of marketing messages at any time by following the unsubscribe instructions provided in the message.
Marketplace Transactions
Scope of Services: Transit Gigs sources work opportunities (“Gigs”) for transportation and related services, then assigns these Gigs to registered Service Providers through the Platform. Service Providers are responsible for completing Gigs as directed by Transit Gigs.
Fees and Payment: Service Providers will be paid for completed Gigs based on the agreed rates displayed on the Platform at the time of assignment. Transit Gigs charges a service fee, typically a percentage of the transaction amount, which is disclosed to Service Providers.
Payment Processing: Transit Gigs processes all payments directly. Service Providers receive payment via the Platform, minus any applicable service fees, within the designated payment schedule as outlined in the Service Provider’s agreement with Transit Gigs.
Independent Contractor Relationship Service Providers on Transit Gigs are independent contractors, not employees of Transit Gigs. The Platform only facilitates assignments between Service Providers and Transit Gigs; it does not oversee, manage, or guarantee the quality or safety of services provided by Service Providers.
User Conduct You agree to use the Platform for lawful purposes and in compliance with these Terms and all applicable laws and regulations. Prohibited activities include, but are not limited to:
Misrepresenting your identity or affiliation with any person or entity.
Posting false or misleading information.
Engaging in harassment, discrimination, or abusive behavior.
Interfering with the operation of the Platform or the experience of other users.
User Content Any content you post or submit on the Platform remains your property, but by posting, you grant Transit Gigs a worldwide, royalty-free license to use, modify, display, and distribute such content as necessary to provide and promote our services.
Disputes and Cancellations
Dispute Resolution: In case of a dispute between a Client and Service Provider, the parties are encouraged to resolve the issue directly. Transit Gigs may, at its discretion, assist in resolving disputes but is not obligated to do so.
Cancellations and Refunds: Cancellation and refund policies may vary by Service Provider. Clients should review each Service Provider’s terms before booking. Refunds, if applicable, will be processed according to the terms of the payment processor.
Limitation of Liability Transit Gigs provides the Platform on an “as-is” and “as-available” basis without warranties of any kind, either express or implied. Transit Gigs is not liable for any damages arising out of or related to your use of the Platform or any services obtained through the Platform. In no event shall Transit Gigs’ liability exceed the amount paid by you in the six months preceding the event giving rise to liability.
Indemnification You agree to indemnify, defend, and hold harmless Transit Gigs, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Platform, violation of these Terms, or any interactions or transactions with other users.
Termination Transit Gigs reserves the right to suspend or terminate your account and access to the Platform at any time for any reason, including, without limitation, breach of these Terms. Upon termination, any remaining balances owed or in process will be managed in accordance with our policies and applicable law.
Governing Law and Jurisdiction These Terms are governed by the laws of the state in which Transit Gigs is headquartered, without regard to its conflict of law principles. Any disputes arising out of these Terms or the Platform will be resolved in the courts located in that state.
